Limited Warranty Details
NEU APPLIANCE PARTS LIMITED WARRANTY
This Limited Warranty Information (“Warranty”) is valid solely between the Selling Party (“Neu Appliance Parts”) and the Purchaser (“Customer”) for items (“Appliance Parts”) which are purchased solely through the sales channel: www.NeuApplianceParts.com (individually a “Party,” collectively “Parties”). Warranties are non-transferable, non-assignable, and non-negotiable.
What are Electronic Parts and Mechanical Parts?
Both Electronic Parts and Mechanical Parts are Appliance Parts. An Electronic Part has the intended use [as a whole or partially] is to receive, transmit or carry electricity or any electrical current, electrical load or, relies on electricity in any form to perform an intended action. Electronic Parts may contain components which may include, but are not limited to: wires, motors, electrical switches, timers, fuses, capacitors, compressors, sensors or control boards. Mechanical Parts are everything else that are not Electronic Parts.
What Warranties Are Available?
(1) 1-Year Mechanical Part Warranty
Electronic Parts are not eligible. Warranty duration begins from the date of purchase and expires three hundred and sixty-five (365) days after the purchase date. Parts covered by 1-Year Mechanical Part Warranty may be eligible for an equal value replacement as determined by Neu Appliance Parts. This warranty covers ONLY defects in material and workmanship. No warranty coverage is extended to the appliance or the property in which the Appliance Part is contained or installed to. It is solely the responsibility of the customer to maintain the condition and quality of the part prior to installation. All Appliance parts are sold as-is pertaining to cosmetic condition.
(2) 30-Day Electronic Part Warranty
Electronic Parts may be eligible. Warranty duration begins from the date of purchase and expires thirty (30) days after the purchase date. Parts covered by 30-Day Electronic Part Warranty may be eligible for an equal value replacement as determined by Neu Appliance Parts. This warranty covers ONLY defects in material and workmanship. No warranty coverage is extended to the appliance or the property in which the Appliance Part is contained or installed to. It is solely the responsibility of the customer to maintain the condition and quality of the part prior to installation. All Appliance parts are sold as-is pertaining to cosmetic condition.
Neither of these warranties continues after Appliance Part unit is removed from the location where it was originally installed.
What Are the Warranty Criteria?
For an Appliance Part to be eligible for any warranty coverage the following terms must be met:
1. The Appliance Part was purchased directly from www.NeuAppliancesAustin.com.
Parts purchased using eBay, Amazon, private party, third party sellers or any other sales channels void any warranty eligibility.
2. The installation was performed by a trained/certified appliance repair technician.
Parts do not come with installation instructions, manufacturer guidelines or any guides or aids to assist in the correct installation of Appliance Parts. It is the responsibility of the Customer to research applicable manufacturer instructions and to have a trained/certified appliance repair technician install the part according to any such instruction. Failure to do so will void any warranty coverage that may have applied. This warranty covers defects or malfunctions in materials and workmanship that appear under normal use and maintenance. Damage due to wear and tear such as rips, tears, abrasion or UV degradation, misuse or neglect is not covered.
3. The Appliance Part un-damaged upon delivery.
It is possible an Appliance Part may have been damaged during shipping, storage or various other sources. Damaged parts should not be installed, they have no warranty eligibility and, they must be returned within the return policy guidelines. It is the Customer’s responsibility to thoroughly inspect the parts immediately upon delivery. Neu Appliance Parts makes no-guarantees parts will be received in working condition. Shipping and handling of Appliance Parts incurs some risk the Customer solely inherits.
4. The Appliance Part is used and maintained in accordance with manufacturer’s instruction.
Appliance Parts should be operated in accordance with manufacturer instruction. Appliance Parts are not to be used in any manner other than manufacturer intended purposes. Some Appliance Parts may require maintenance to ensure proper operation. It is the sole responsibility of the Customer to perform all research necessary to understand and perform any maintenance an appliance part may require.
5. The Appliance Part is compatible with the installation appliance.
Some Appliance Parts may or may not be compatible with multiple model appliances. Neu Appliance Parts makes no guarantees to which appliance model an Appliance Part is compatible with. It is the customer’s responsibility to perform all research necessary to verify the correct part for the model of appliance. Contact your appliance’s manufacturer to ensure the Appliance Part is compatible prior to placing an order.
Neu Appliance Parts Reserves the right to void any warranty for any reason at their sole discretion without notice.
How Do I Make A Claim?
Warranty claims must be submitted by the Customer at www.NeuApplianceParts.com/Warranty/Claims prior to the warranty expiration date to be valid. Third parties, vendors, service providers or representatives are ineligible to submit warranty claims on behalf of the Customer.
Customer shall ship parts to Neu Appliance Parts at Customer’s expense. Claim procedure and shipping instructions will be provided by a Neu Appliance Parts Representative within thirty of a valid warranty claim. Upon receipt of the Appliance Part(s); Neu Appliance Parts will inspect the Appliance Part and at their sole discretion to determine if the part’s condition is within terms of this warranty agreement. If the Appliance Part is deemed to breach the warranty agreement, the Customers may request the part to be returned at the cost of the Customer within five business days. If the part is deemed to abide by the warranty terms, then a replacement Appliance Part of equal or lesser value [Determined solely by Neu Appliance Parts] will be issued to the Customer. Neu Appliance Parts will bear the cost of return shipping to the original shipping location, unless an alternative delivery location is requested by the Customer, where additional fees may apply. If a replacement is not readily available, then a store credit will be issued for the original price of the Appliance Part excluding any taxes or shipping charges or fees.
The replacement of any part does not extend the warranty period.
Customer agrees that these remedies are the Customer’s exclusive remedies for breach of all warranties, express or implied.
EXCLUSIONS OF DAMAGES POLICY
In no event will either party be liable to the other for any special, incidental or consequential damages, whether based on breach of contract, tort (including negligence) or otherwise, whether or not that party has been advised of the possibility of such damage including, but is not limited to:, appliance damage, property damage, water damage, food spoilage, wall and/or flooring damage, clogged drains, or any damage that occurs during the shipping process, whether transportation is done by the purchase or purchaser’s designated party, a third party shipping company, or a Neu Appliances’ team member, and whether such claim is based on contract, tort (including negligence), strict liability or otherwise.
THE EXPRESSED WARRANTIES IN THIS ARTICLE ARE THE ONLY WARRANTIES AND GUARANTEES NEU APPLIANCES WILL MAKE. THERE ARE NO OTHER WARRANTIES OR GUARANTEES, WHETHER STAUTORY, WRITTEN, ORAL, WRITTEN, EXPRESSED, OR IMPLIED. IN PARTICULAR, THERE ARE NO IMPLIED WARRANTIES OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THERE ARE NO STATUTORY, ORAL, OR IMPLIED CONDITIONS. THERE ARE NO IMPLIED WARRANTIES AGAINST REDHIBITORY DEFECTS, VICES, OR DEFECTS, HIDDEN OR OTHERWISE.
ARBITRATION CLAUSE
Any controversy or claim arising out of or relating to this warranty, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration hearing shall take place within the State of Texas in the County of Travis. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
In the event that any legal proceeding is brought to interpret or enforce any right or obligation under this warranty, the Parties each agree to waive their right to a jury trial. In addition, the prevailing Party shall recover its reasonable court costs and attorney fees from the non-prevailing Party. The Parties agree to make a good-faith effort at informal and/or formal settlement negotiations prior to filing of any arbitration.
